The Department of Homeland Security under Donald Trump's administration has said that all foreign nationals staying in the US for more than 30 days must register with their government and non-compliance would mean possible penalties and imprisonment.
"Foreign nationals present in the US longer than 30 days must register with the federal government. Failure to comply is a crime punishable by fines and imprisonment. @POTUS Trump and @Sec_Noem have a clear message to Illegal aliens: LEAVE NOW and self-deport," the department posted on X, tagging President Trump's office and Krishi Noem, the secretary of the Department of Homeland Security.
Although this decision will not apply directly to foreign nationals in the USA on visas such as the H-1 B or student permits, it shows that stricter enforcement of American laws in preventing foreign nationals from staying in the country without authorization will be followed. If someone on an H-1 B visa loses his job but fails to exit the country within the stipulated time frame, he may face action. Hence, students and H-1 B Visa holders must ensure that their stay in the US complies with the requirements.
U.S Department of Homeland Security post called 'Message to Illegal Aliens' urges the illegally residing foreign nationals to self-deport. It also includes the benefits of doing so.
"Self-deportation is safe. Leave on your own terms by picking your departure flight. Keep money earned in the US if you self-deport as a non-criminal illegal alien," it says.
It further states that self-deportation will help keep a future opportunity for legal immigration open, as those self-deporting may also qualify for subsidised flights in case they cannot afford to leave the country.
The information posted states that illegal foreigners will be deported once identified by the Homeland Security department, and it therefore lists the consequences of failure to inform authorities in time. "A fine of $998 per day if you received a final order of removal and stayed. A fine of $1,000-$5,000 if you fail to self-deport after claiming that you will. If you fail to self-deport, you may be subject to jail time," it continued. It said that undocumented foreign nationals who do not register will also be banned from returning under the legal immigration system into the US.
